Bonjour-santé® subscription services
Bonjour-santé® offers a subscription service that gives its clients access to different medical appointment scheduling services (the “Services”).
Your subscription to Bonjour-santé® will be automatically renewed every month until it is cancelled. To use the Bonjour-santé® Services, you will require access to the Internet and a device that is compatible with the Bonjour-santé® application as well as provide a valid and accepted method of payment, which you may modify from time to time. Unless you cancel your subscription before your monthly invoice date, you authorize us to invoice your subscription for the following month according to the payment method you provided.
Moreover, by subscribing you acknowledge and confirm that you are of legal age in your province of residence and may, therefore, benefit from the Services.
2. SUBSCRIPTION FEES
2.1. Types of Subscriptions. Bonjour-santé® offers many types of subscriptions. For specific information about each type of subscription and to compare the details regarding the Services covered - click here.
2.2. Billing. Subscription fees for the Bonjour-santé® Services as well as any other fees that you may incur by using the Services, such as applicable sales taxes, must be paid every month using your registered method of payment on the day that the term of your subscription begins. Only registration fees are payable at the time of subscribing to any of the plans offered. All your invoices will always be accessible from your account page. You acknowledge and agree that the payment due date may change; for example, if your method of payment is not successfully registered. It is recommended that you to review your account information to familiarize yourself with the details regarding your method of payment and your payment due dates.
2.3. Method of Payment. You may change your method of payment from your subscription account (failed payment) on the Bonjour-santé® website. In the event that any payment cannot be properly processed due to an expired credit card, insufficient funds or any other reason, and you do not change your method of payment or you close your account, we may suspend your access to the Services until we receive valid payment. Your account will, however, remain active until the following payment due date. If this payment also fails to be processed, your account will be deactivated. If you later reactivate your subscription, you will have to pay the registration fees again. By updating your method of payment information, you authorize us to process subsequent payments using the new method of payment and you will remain liable for all sums that are not collected.
2.5. Changes to Service Rates and Plans. We may change our Services and their respective rates. However, any changes to any Service rate or plan will only apply to your subscription at least thirty (30) days after you have been notified of such change.
3. ACCESS TO ACCOUNT
You are responsible for the confidentiality of your username and password, both of which are only for your personal use. You are also responsible for keeping your account information (e.g. email address, telephone number) up to date so that Bonjour-santé® may send you notifications or other communications. We may close or suspend your account in order to protect you as well as Bonjour-santé® or our partners from any identity theft or other fraudulent activity.
4. BONJOUR-SANTÉ® SERVICES
4.1. Use. The Bonjour-santé® Services are intended to be used exclusively for personal use and not for commercial purposes. You agree to use the Bonjour-santé® Services in accordance with any applicable laws, rules or regulations in effect and according to the other restrictions to using the Services.
4.2. Availability of Appointments and Doctors’ Schedules. The availability of appointments may vary from one region to another or from one day to another based on different factors that are beyond the control of Bonjour-santé®. Bonjour-santé® may in no way intervene in the internal management of the different clinics. Many factors may influence the smooth running and turn around time of appointments in a clinic. Moreover, Bonjour-santé® has no control over doctor availability and will never grant priority status to any person using the Services.
4.3. Improvements to Services. The features and functionalities offered by subscribing to any Bonjour-santé® plan may be updated from time to time to improve the Services offered to the users.
5. WARRANTY AND LIMITATION ON LIABILITY
The Bonjour-santé® Services are provided without warranty or condition regarding the smooth running of the system. We do not guarantee that the Services will function without interruption or error. This clause does not limit any warranty or right that may be provided under any applicable consumer protection law or regulation.
Bonjour-santé® may not in any way be held liable for any damage caused by using the Services or any other direct or indirect damage incurred in connection with the direct or indirect use of the Services or inability to use the Services for any reason that is beyond the control of Bonjour-santé®. More precisely, Bonjour-santé® denies all liability, such as including any liability regarding any delay in providing the Services.
6. MISCELLANEOUS PROVISIONS
6.1. Client Services. To learn more about our Services and how they function or if you need help with your account, please contact Bonjour-santé® client services.
6.2. Survival. If any provision hereof is held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the other provisions will not be affected.
6.4. Electronic Communication. You consent to us sending you information about your account to any email address or other electronic means of communication that you give at the time of registering.
